went back and read your post, last payment 05- no sol.  but you mentioned the account number they are suing you on is wrong--do you know this to be 100% true?

If so you can deny the debt and force them to come up with proof the account number they are suing you on is legit.

not sure this will work but, if they can't get the account number right how do you know its your account or the amount alleged owed is correct.

Florida courts will send you to mediation, either the day of the pre trial or shorty thereafter, you can try and negotiate then.

Did you check to see if they are licensed in this state?

Do they own the account ?

Somewhere in the answer it stated your name, address etc if its true you have to admit.

You need to post the complaint.

Well, who was the person that stated they were the custodian of the records.

Is that the person who signed the the affidavit that CO didn't know what your questions was.

Did she strike all the evidence and if she did-why is she waiting?

Gulf I will ask someone to help you on this-actually I would copy and paste what you wrote on www.infinitecredit.com--I am saying this for a reason. I am having family issues and not able to really help

No they didn't answer anything and I would point that out to the Judge.  I would also point out they don't know who signed the affidavit of debt-which is the paper that says I am the records custodian and this debt is hers.

Who signed yours. If they don't know who signed it how do they know they are employed by Cap One and not Trak America which is a collection agency, therefore its hearsay.

Also I would point out they didn't answer any questions just denials and you recieved this at the 11th hour.  If the Plaintiff could have given you these denials months ago at which time you could have prepared your defense.  You are asking the Court to strike the plaintiffs evidence and you are requesting sanctions.

Do you have the case laws for VA that says CC are open contracts and have a 3 yr SOL.

Technically yes, but from what I have heard the courts will allow them to get a license.  However you can use that to show them you'll fight.  I think if you look through all postings it is mentioned on how to find out.  I think you have to write the licensing board and get it in writing and then file a motion to dismiss.

Anyone else care to help here.

They have until 5 pm on the 3rd to give it to you.  What you need to do now is type the final order for the Judge to sign.

Did you ever counterclaim anything?
