When being sued on "Open Account" is it true that the attorney does not have to provide proof of a signed credit card agreement?  Heard this from a friend of a lawyer.


Yes and no. They may not have to show a sighned agreement if they can show you made payments. If you post the compaint here we may be able to help more...

FD, yeah I know... it's hard to do when you work full time.  I did manage to catch a few hours of small claims, but that was pre-trial conferences, and it wasn't a real judge.  I don't even know if it's possible to sit in on hearings and such because from what I understand those are all heard in the judge's chambers, not in open court, and good luck finding out when they are scheduled for.   

I could have watched a family law trial if I'd wanted to....

I'm trying to prove that the JDB is reporting, and that they are reporting incorrectly as to amounts, type of account, etc.

Can I use a redacted copy instead of the whole thing, can I attach only the page they are on and black line over anything not related to them?


This is great question but I am not 100% sure of the answer.

It depends on whatb you are tring to prove with them. If you are tring to proof they reported on you then there should be no problem getting them admitted. Dont forget if you are doing discovery you can ask them to admit they reported in admissions and you ask if and when they reported as well.
